1. Scope of These Terms
Pivotal Services LLC (“Pivotal Services,” “we,” “us,” or “our”) operates pivotalservices.net (the “Site”).
These Website Terms of Use (“Terms”) govern access to and use of the Site and its content. They do not govern consulting, advisory, or other professional services provided by Pivotal Services. Any such services are governed exclusively by a separate written agreement between Pivotal Services and the applicable client.
Your use of the Site is subject to these Terms. If you do not accept them, do not use the Site.
2. Informational Purpose
The Site provides general information about Pivotal Services, Scott McGhee’s professional experience, execution recoveries, operating perspectives, and related subjects.
Site content is provided for general informational purposes. It is not individualized business advice and should not be treated as a substitute for analysis based on the specific facts, risks, and circumstances of an organization.
Nothing on the Site constitutes legal, tax, accounting, investment, or other regulated professional advice. Nothing on the Site is an offer or commitment to provide services or enter into a business relationship.
3. No Client or Confidential Relationship
Accessing the Site, reading its content, sending an inquiry, or receiving a response does not create a client, advisory, fiduciary, confidential, or other professional relationship with Pivotal Services or Scott McGhee.
A professional relationship is created only through a separate written agreement signed by Pivotal Services and the applicable client.
Do not submit confidential, proprietary, legally privileged, export-controlled, or highly sensitive information through the Site or by email unless appropriate protections have first been established in writing. Information sent before such an agreement is in place may not be treated as confidential, except where otherwise required by law.
4. Ownership of Site Content
Unless otherwise stated, the Site and its content—including text, articles, case studies, photographs, graphics, design elements, logos, and other materials—are owned by Pivotal Services LLC, Scott McGhee, or their respective licensors and are protected by applicable intellectual-property laws.
All rights not expressly granted in these Terms are reserved.
Third-party names, trademarks, logos, and other materials remain the property of their respective owners.
5. Limited Permission to Use the Site
You may access and view the Site for lawful personal or internal business-evaluation purposes.
You may print or save limited portions of Site content for those purposes, provided that you:
Do not alter the content;
Retain all copyright, attribution, and proprietary notices;
Do not represent the content as your own; and
Do not use the content commercially or redistribute it publicly without written permission.
No other license or right is granted by implication, estoppel, or otherwise.
Nothing in these Terms limits rights that cannot lawfully be restricted, including uses permitted under applicable copyright law.
6. Prohibited Uses
You may not:
Copy, reproduce, republish, distribute, sell, license, or commercially exploit substantial portions of the Site without written permission;
Remove or obscure copyright, attribution, trademark, or proprietary notices;
Misrepresent the source, ownership, meaning, or authorship of Site content;
Use the Site or its content unlawfully, fraudulently, or in a manner that infringes another person’s rights;
Attempt to gain unauthorized access to the Site, its infrastructure, or related systems;
Introduce malicious code or interfere with the Site’s operation, security, or availability;
Impersonate Pivotal Services, Scott McGhee, or another person or organization; or
Use automated tools to scrape, harvest, reproduce, data-mine, train models on, or systematically extract substantial portions of the Site without written permission.
The final restriction does not prohibit ordinary indexing by legitimate public search engines.
We may restrict or terminate access to the Site when reasonably necessary to protect the Site, our rights, other users, or third parties.
7. Third-Party Links and Services
The Site may contain links to websites, platforms, publications, or services operated by third parties.
Those links are provided for information or convenience. Pivotal Services does not control and is not responsible for third-party content, availability, security, terms, or privacy practices.
A link does not imply endorsement unless expressly stated.
8. Site Accuracy and Availability
We make reasonable efforts to present useful and accurate information, but Site content may contain errors, omissions, or information that becomes outdated.
We do not guarantee that the Site or its content will always be accurate, complete, current, uninterrupted, available, or free from harmful components.
We may modify, remove, suspend, or discontinue any portion of the Site without notice.
9. Privacy
Information collected through or in connection with the Site is handled as described in our Privacy Policy.
The Privacy Policy explains what information may be collected, how it may be used, and the choices or rights that may be available to visitors.
10. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.
Pivotal Services disclaims all express and implied warranties relating to the Site, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, security, and availability.
Nothing in these Terms excludes a warranty or obligation that cannot lawfully be excluded.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Pivotal Services LLC, Scott McGhee, and their respective officers, agents, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:
Access to or use of the Site;
Inability to access or use the Site;
Reliance on Site content;
Third-party links or services; or
Unauthorized access to or alteration of information transmitted through the Site.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
12. Governing Law and Venue
These Terms and any dispute arising solely from the Site or these Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Any legal proceeding arising from the Site or these Terms must be brought in a state or federal court of competent jurisdiction located in Virginia, and each party consents to the jurisdiction of those courts.
This section does not govern disputes arising under a separate consulting or services agreement, which will be governed by the terms of that agreement.
13. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.
A failure to enforce any provision does not waive the right to enforce it later.
14. Entire Agreement Regarding Site Use
These Terms and the Privacy Policy constitute the entire understanding concerning access to and use of the Site.
They do not replace, amend, or supplement an executed nondisclosure agreement, master services agreement, statement of work, or other written agreement governing professional services.
If a conflict exists, the separately executed agreement controls with respect to the subject matter it governs.
15. Changes to These Terms
We may update these Terms when the Site, our practices, or applicable requirements change.
The revised Terms will be posted on this page with an updated effective date. Continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
